C-File Review Pack Purchase Terms

C-File Review Pack Purchase Terms

Effective date: September 4, 2026
Version: cfile-review-pack-v1
Service provider: Dmytro Usenko
Trading name: VBMS Reviewer

These C-File Review Pack Purchase Terms (the "Purchase Terms") govern each purchase of a C-File Review Pack through reports.vbmsreviewer.com. These Purchase Terms supplement the VBMS Reviewer Terms of Use and Privacy Policy. If these Purchase Terms conflict with the general Terms of Use with respect to a C-File Review Pack order, these Purchase Terms control for that order.

By checking the acceptance box and completing checkout, the purchaser ("Customer," "you," or "your") confirms that it has reviewed and agrees to these Purchase Terms, the VBMS Reviewer Terms of Use, and the Privacy Policy.

1. Professional Business Use Only

The C-File Review Pack is offered only for lawful professional and business use by VA disability attorneys, VA-accredited claims agents, law firms, and authorized professional case teams. It is not marketed or offered as direct representation, claims assistance, or legal advice to an individual veteran or claimant.

United States sales only

The C-File Review Pack is offered for purchase only to professional or business customers located and billed in one of the 50 United States or the District of Columbia. It is not offered for purchase in U.S. territories or possessions or in any country outside the United States.

Eligibility is determined by the location of the purchaser, not the current location of the veteran, survivor, or claimant whose authorized records are submitted. The client matter must relate to benefits administered by the U.S. Department of Veterans Affairs.

You represent that:

  • you are purchasing the service for professional or business use;
  • you or the purchasing organization is located in one of the 50 United States or the District of Columbia, and the U.S. billing address supplied at checkout is complete and accurate;
  • you are authorized to act for your organization and to accept these Purchase Terms;
  • you are authorized to possess and submit all records and personal information uploaded for the review; and
  • your use of the service and the resulting reports will comply with applicable law, professional duties, client instructions, and confidentiality obligations.

You may not circumvent the geographic restriction by supplying a false address or other inaccurate location information. We may reject, cancel, or refund an order without processing if the purchaser does not satisfy these geographic requirements or if we cannot reasonably verify eligibility.

VBMS Reviewer is not affiliated with, endorsed by, or acting on behalf of the U.S. Department of Veterans Affairs or any other government agency.

2. The C-File Review Pack

One purchase covers the review of records for one client matter. The pack includes four electronic outputs:

  1. Evidence Review
  2. Attorney Brief, also described as a Strategic Review
  3. Signals
  4. Case Board

The pack is a fixed-format document-review service. It does not include access to the VBMS Reviewer professional workspace, a subscription, ongoing monitoring, claim preparation or filing, legal representation, a medical opinion, a nexus opinion, or unlimited revisions.

If records for more than one client matter are submitted under one order, we may pause processing and require separate orders or written approval of a different scope.

3. Report Samples and Expected Format

The report samples linked before checkout illustrate the general type, organization, presentation, and level of detail expected from the C-File Review Pack. You acknowledge that you had the opportunity to review the samples before purchasing.

Actual reports will not be identical to the samples. Their length, sections, findings, issue counts, citations, and level of detail will depend on the size, quality, content, organization, and completeness of the records submitted. We may update report formatting and presentation over time while preserving the four-output scope described above.

A report's failure to identify a particular issue, theory, condition, effective date, argument, or item of evidence that you expected to find does not, by itself, mean that the service was not delivered or that the report is defective.

4. Customer Records and Information

You are responsible for providing complete, readable, and relevant records for the client matter. The review is limited to the files and case-context information you submit. We are not responsible for materials that were not submitted, pages that are missing or unreadable, incorrect metadata, corrupted files, inaccurate information provided by you, or records uploaded after processing begins unless we expressly agree to include them.

You must not submit records unless you have all rights, permissions, notices, consents, and authorizations required to provide them to VBMS Reviewer for processing. You remain responsible for determining whether use of the service is consistent with your professional, contractual, confidentiality, and data-protection obligations.

5. AI-Assisted Processing and Required Professional Verification

VBMS Reviewer uses automated and AI-assisted methods to organize records, extract information, identify possible review signals, and produce structured outputs. Automated systems can make mistakes.

Reports may contain omissions, incorrect classifications, incomplete timelines, inaccurate summaries, incorrect inferences, citation errors, or other errors. No report should be relied on without review of the underlying source records.

You agree that:

  • every citation, fact, date, characterization, and suggested issue must be independently reviewed by a qualified professional before use;
  • the reports are research and workflow-support materials, not final legal work product;
  • VBMS Reviewer does not make decisions for you or your client;
  • you remain solely responsible for legal analysis, strategy, advice, deadlines, filings, communications, and case decisions; and
  • you will not describe an output as having been verified by VBMS Reviewer or as a substitute for attorney or accredited-representative review.

6. No Legal, Medical, or Government Representation

VBMS Reviewer is a technology and document-review provider. The service does not create an attorney-client relationship, representative-client relationship, fiduciary relationship, or medical-provider relationship between VBMS Reviewer and you, your firm, any veteran, survivor, claimant, or other person.

The reports do not constitute legal advice, a legal opinion, medical advice, a medical diagnosis, a medical opinion, a nexus opinion, an appraisal of claim value, or a recommendation to file or not file a claim or appeal. We do not submit claims, appeals, evidence, or forms to the Department of Veterans Affairs and do not appear in any proceeding.

7. No Outcome Guarantee

We do not guarantee that a report will identify every relevant fact, condition, issue, error, deadline, claim path, appeal path, rating question, effective-date question, or item of favorable or unfavorable evidence.

We do not guarantee any claim, appeal, rating, effective date, award, recovery, fee, settlement, or other legal or financial outcome. Customer decisions and government decisions remain outside our control.

8. Price, Payment, and Taxes

The price displayed at checkout applies to the order. Payment is collected through Stripe or another disclosed payment processor. You authorize the processor to charge the selected payment method for the amount displayed at checkout.

The service is a one-time purchase and does not automatically renew. Purchasing a C-File Review Pack does not create a subscription or provide access to the professional workspace.

Applicable taxes may be calculated and collected at checkout. You are responsible for taxes associated with the purchase except to the extent we are required to collect and remit them.

Payment-card information is handled by the payment processor under its own terms and privacy practices. VBMS Reviewer does not receive or store complete payment-card numbers.

9. Submission and Processing

After payment, you must complete the order form, confirm your authorization, and upload the records through the secure submission page. Processing does not begin until the required information and files have been successfully submitted.

You must complete submission within 90 days after purchase. If you do not complete submission within that period, we may close the order after reasonable notice. Any extension or credit is at our discretion except where applicable law requires otherwise.

Estimated turnaround times shown on the website, in checkout, or in an order email are estimates, not guaranteed deadlines, unless we expressly agree otherwise in writing. Large, damaged, encrypted, disorganized, or technically difficult files may require additional time.

We may pause or reject processing if files are unsafe, corrupted, unreadable, unlawfully submitted, outside the stated scope, or technically incompatible with the service. If we reject an order before substantive processing begins, we will provide a refund unless the rejection results from fraud, abuse, or unlawful conduct.

10. Delivery and Availability

We deliver completed reports electronically to the delivery email address provided with the order, normally through private report links or an equivalent electronic delivery method.

You are responsible for providing an accurate delivery email address, checking spam or security filters, and notifying us if delivery is not received. Delivery is complete when the reports or access links are sent to the supplied address and our delivery system records successful handoff, subject to any confirmed delivery failure.

Private report links remain available for 30 days after delivery. You are responsible for downloading and securely retaining any reports you need before the links expire. We do not guarantee that expired links or deleted reports can be restored.

11. Corrections, Cancellations, and Refunds

You may request cancellation and a full refund before record processing begins.

If we determine that a purchaser is outside the eligible U.S. sales area, we may cancel the order and issue a full refund rather than begin or continue processing.

Once substantive processing begins, the order is a customized digital service and is not refundable because of:

  • a change of mind;
  • disagreement with the report's analysis, prioritization, or characterization;
  • dissatisfaction with the number of findings;
  • absence of an expected issue, theory, condition, or claim path;
  • facts or documents that were not included in the submitted records; or
  • failure to download the reports before the 30-day links expire.

If we fail to deliver all four outputs, process the wrong submitted matter, or confirm a material technical defect attributable to our service, you must notify us within seven calendar days after delivery. Our first remedy will normally be to correct or reprocess the affected output. If correction or reprocessing is not reasonably possible, we may refund some or all of the order price.

Nothing in this section limits rights or remedies that cannot lawfully be excluded. Before initiating a payment dispute, please contact us at contact@vbms.review so that we can investigate delivery or technical issues promptly.

12. Confidentiality, Privacy, and Security

Our handling of personal information is described in the VBMS Reviewer Privacy Policy. Where a separate written data-processing agreement, confidentiality agreement, business associate agreement, or customer agreement applies, that agreement also governs according to its terms.

We use commercially reasonable administrative, technical, and organizational safeguards designed to protect submitted records. No system or transmission method is completely secure, and we cannot guarantee absolute security.

You are responsible for safeguarding report links and downloaded outputs. You must not share private links with unauthorized persons.

13. Ownership and Permitted Use

As between you and VBMS Reviewer, you retain your rights in the records and information you submit. You grant us a limited right to host, copy, process, transmit, and use submitted materials only as needed to provide, secure, support, and comply with legal obligations relating to the service.

VBMS Reviewer and its licensors retain all rights in the service, software, report templates, interfaces, prompts, processing methods, models, documentation, branding, and general know-how.

After full payment, you receive a non-exclusive, perpetual license to use, copy, download, adapt, and share the delivered reports as reasonably necessary for the applicable client matter, including internal firm work, client communications, submissions to the Department of Veterans Affairs, and related proceedings. You may not resell the service, report templates, or substantially similar outputs as a competing product, or use the reports to reverse engineer the service.

14. Acceptable Use

You may not:

  • use the service for unlawful, fraudulent, deceptive, or abusive purposes;
  • submit records you are not authorized to provide;
  • interfere with or attempt unauthorized access to the service;
  • upload malware or intentionally harmful content;
  • use automated means to exceed or bypass order limitations; or
  • misrepresent the reports as independently verified legal or medical opinions.

We may suspend an order or access when reasonably necessary to protect the service, submitted records, other customers, or legal compliance.

15. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." VBMS REVIEWER DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, NON-INFRINGEMENT, AND RESULTS.

No statement outside these Purchase Terms creates a warranty unless expressly identified as a warranty in a written agreement signed by an authorized representative of VBMS Reviewer.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VBMS REVIEWER AND ITS OWNERS, AFFILIATES, PERSONNEL, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST FEES, LOST BENEFITS, LOST DATA, BUSINESS INTERRUPTION, MISSED DEADLINES, CLAIM OR APPEAL OUTCOMES, OR THE COST OF SUBSTITUTE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A C-FILE REVIEW PACK ORDER WILL NOT EXCEED THE AMOUNT ACTUALLY PAID FOR THAT ORDER.

These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not apply to liability that cannot lawfully be limited or excluded.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless VBMS Reviewer and its owners, affiliates, personnel, and contractors from third-party claims, losses, and reasonable costs arising from your unlawful use of the service, your submission of records without required authority, or your violation of these Purchase Terms. This section does not require indemnification for claims caused solely by VBMS Reviewer's unlawful conduct.

18. Governing Law and Disputes

These Purchase Terms are governed by applicable law. Before filing a formal claim, each party will make a good-faith effort to resolve the dispute by contacting the other party. Any unresolved proceeding must be brought before a court that has jurisdiction under applicable law. Nothing in these Purchase Terms limits any mandatory right, remedy, or venue rule that cannot lawfully be excluded.

19. Changes to These Purchase Terms

The version accepted at checkout governs that order. We may update these Purchase Terms for future purchases by posting a revised version and effective date. Changes do not retroactively alter the terms of a completed order unless required by law or agreed in writing.

20. General Terms

If any provision is held unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. You may not assign an order or these Purchase Terms without our written consent. We may assign them in connection with a merger, acquisition, reorganization, or sale of the relevant business or assets.

These Purchase Terms, the Terms of Use, the Privacy Policy, and any applicable written customer agreement are the complete agreement concerning the C-File Review Pack order. Purchase-order terms supplied by a Customer do not apply unless expressly accepted by us in writing.
